Prohibition on Private Communications During Procurement Process
Businesses and individuals that respond to Requests for Qualifications (RFQ’s) or Requests for Proposals (RFP’s) or any competitive bid let by the El Paso County Hospital District may not engage in “private communications” with any member of the Board of Managers of the Hospital District during the procurement process. “Private communication” means any communication other than a communication that takes place at a posted meeting of the full Board of Managers or a meeting of a committee of the Board of Managers, or a meeting which has been specifically authorized by the Board for the purpose of communicating with a potential vendor. “During the procurement process” begins upon issuance of the RFQ, RFP, or bid and continues until selection of the vendor and execution of a contract with the vendor.
This prohibition on private contacts is mandated by the County Code of Ethics adopted by the El Paso County Commissioners and which applies to the El Paso County Hospital District Board of Managers.
